JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos.1 to 5 in Crime.No.250/2025 registered by K.R.Nagar Police Station, Mysuru District for the offences punishable under Sections 189(2), 191(2), 115(2), 118(1), 118(2), 109, 351(2), 352 & 190 of BNS, 2023 are before this Court in these four petitions filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel appearing for the parties. 3. FIR in Crime No.250/2025 was registered by K.R.Nagar Police Station, Mysuru District against the petitioners herein for the aforesaid offences on the basis of first information dated 13.06.2025 received from Sri Ramachandra H.G. S/o Late Javaregowda, who is one of the injured victim. Apprehending arrest in the said case, the petitioners had filed Crl.Misc.No.5147/2025, - 6 - HC-KAR NC: 2025:KHC:27113 CRL.P No. 9500/2025 C/W CRL.P Nos. 9526/2025, 9527/2025 AND 1 OTHER Crl.Misc.No.5147/2025, Crl.Misc.No.5148/2025 and Crl.Misc.No.5152/2025 which were rejected by the jurisdictional Sessions Court on 01.07.2025. Therefore, they are before this Court. 4. Learned counsel for the petitioners submits that there is a business rivalry and dispute between the parties. The petitioners are falsely implicated in the present case. The incident in question had taken place at 11.30 p.m, on 12.06.2025. The first information is belatedly filed at 7.30 p.m, on 13.06.2025. Accordingly, he prays to allow the petitions. 5. Per contra, learned Addl. SPP and learned counsel for defacto complainant have opposed the bail petitions. They submit that accused persons had trespassed into a dwelling house and had assaulted inmates of the house. Anil Kumar, who is one of the injured victim in the present case has suffered grievous injury as a result of assault made by accused. Accordingly, they pray to dismiss the petitions. - 7 - HC-KAR NC: 2025:KHC:27113 CRL.P No. 9500/2025 C/W CRL.P Nos. 9526/2025, 9527/2025 AND 1 OTHER 6. Perusal of the material on record would go to show that, there is some dispute between the petitioners and victims in the present case in respect of the tender coconut business, in which they are involved. In the alleged incident that had taken place on the night of 12.06.2025, the accused persons, who came in a car allegedly entered into the house of the first informant and assaulted his son Anil Kumar and also one Akashdeep. 7. Perusal of the material on record would go to show that the allegation of assaulting Anil Kumar with a long on his left leg is as against accused no.1. Anil Kumar has suffered fracture injury on his left leg which is certified as a grievous injury, and the other injuries suffered by Anil Kumar are all simple injuries. Grievous injury suffered by Anil Kumar corresponds to the assault made by accused no.1. Akashdeep and Ramachandra who are the other two injured victims in the present case, have only suffered simple injuries in the incident in question. None of the victims have suffered any grievous injury on the vital parts - 8 - HC-KAR NC: 2025:KHC:27113 CRL.P No. 9500/2025 C/W CRL.P Nos. 9526/2025, 9527/2025 AND 1 OTHER of their body as a result of the alleged assault made by accused persons. 8. Considering the aforesaid aspects of the matter, I am of the opinion that, the prayer made by accused No.1 for grant of anticipatory bail is required to be rejected while the prayer made by accused Nos.2 to 5 are required to be answered affirmatively. 9. Accordingly, the following: ORDER The Criminal Petition No.9500/2025 is allowed in part. Crl.P.No.9500/2025 insofar as accused No.1 is concerned is dismissed. Crl.P.No.9500/2025 insofar as accused No.2 is concerned is allowed. Crl.P.No.9526/2025, Crl.P.No.9527/2025 and Crl.P.No.9529/2025 are allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners / accused Nos.2 to 5 in the event of their arrest in - 9 - HC-KAR NC: 2025:KHC:27113 CRL.P No. 9500/2025 C/W CRL.P Nos. 9526/2025, 9527/2025 AND 1 OTHER Crime.No.250/2025 registered by K.R.Nagar Police Station, Mysuru District for the offences punishable under Sections 189(2), 191(2), 115(2), 118(1), 118(2), 109, 351(2), 352 & 190 of BNS, 2023 subject to the following conditions: 1. The petitioners / accused Nos.2 to 5 shall appear before the Investigating Officer in the present case within fifteen days from the date of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with one surety for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2.
