JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 24-09-2025 Heard Mr. Yogesh Chandra Verma, learned Senior Counsel for the petitioner assisted by Mr. Ashok Kumar Kashyap, learned Advocate and Mr. Sunil Kumar Pandey, learned Additional Public Prosecutor for the State. 2. The petitioner apprehends his arrest in a case registered for the offence punishable u/s 126(2), 115(2), 308(2), 308(3), 352, 351(2), 3(5) of BNS. 3. As per prosecution case, the petitioner and other accused persons are said to have demanded Rs.Ten Lacs as ‘rangdari’ while the work of flood control Department was being carried out and they are also alleged to have assaulted the Operator Anuj Kumar. 4. It is submitted by learned Senior Counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. As per F.I.R., allegation against the petitioner is that he caught hold of Anuj Kumar and attempted to take him and no specific accusation of assault or demand of ‘rangdari’ has been alleged against this petitioner. Learned Senior Counsel further submits that offence is punishable under Section 308(2) of the Indian Penal Code, whereunder maximum punishment is of seven years, is triable by the learned Magistrate. Petitioner claims clean antecedents. 5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner. 6. Considering the facts and circumstances of the case, general and omnibus nature of allegation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed. 7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs.
10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned court of SDJM, Barh, Patna, in connection with Ghoswari P.S. Case No.75 of 2025, subject
