Neutral Citation No. - 2025:AHC:119371-DB Court No. - 21 Case :- WRIT - C No. - 23449 of 2025 Petitioner :- Mohammad Vaseem Respondent :- Union Of India And Another Counsel for Petitioner :- Sheo Prasad Yadav,Shri Niwash Yadav Counsel for Respondent :- A.S.G.I.,Krit Raj Singh Hon'ble Manoj Kumar Gupta,J. Hon'ble Ram Manohar Narayan Mishra,J. 1. Heard learned counsel for the petitioner and Sri Krit Raj Singh, learned counsel for respondents. 2. The petitioner has prayed for a writ of mandamus directing the respondents to release the passport of the petitioner bearing Passport No. VO784096 dated 24.2.2021. 3. It appears that the petitioner succeeded in obtaining passport suppressing the fact relating to pendency of Case Crime 132 of 2016 (State vs. Pappu @ Mohd. Waseem) under Sections 325, 323, 504, 506 IPC, Police Station Ahraula, District Azamgarh and Case Crime No. 120 of 2016, under Sections 354(A), 504, 506 IPC and Section 7/8 POCSO Act, Police Station Ahraula, District Azamgarh. 4. When the said fact came to the knowledge of the passport office, it initiated proceedings for impounding the passport. In the said proceedings, the petitioner signed a declaration admitting that the criminal cases are still pending and the passport was surrendered. 5. It is not disputed that the aforesaid criminal cases are still pending against the petitioner as also the fact that the petitioner succeeded in obtaining the earlier passport suppressing the factum relating to pendency of two criminal cases against him. 6. As such we do not find any illegality in the action of the passport office in impounding the passport nor any good reason to direct the respondents to release the seized passport. 7. The petition lacks merits and is accordingly dismissed. . (R.M.N. Mishra, J.) (Manoj Kumar Gupta, J.)
