The present applicant ‘Abhishek Saini’ S/o Gajender Saini is praying for regular bail in relation to First Information Report dated 17.03.2025 P.S. Pathri, District Haridwar, wherein, the present applicant along with 12 others were implicated for the offences punishable under Sections 103(1), 190, 191(2), 191(3), 61(2)(A) of BNS, 2023 and Section 3(1)(r) and 3(2)(v) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 and Section 3/25 of Arms Act. 5. It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and furthermore other three co- accused persons have already been enlarged on bail and claims parity. The three co-accused, who have been enlarged on bail are Harshit Mehta, Harshit Rathi and Babit Kumar. 6. The State as well as learned counsel for the complainant Mr. Narendra Bali have not disputed this fact that the other co-accused have been granted bail and also fairly submits that the applicant is also entitled to get the benefit of parity. 7. After hearing the learned counsel for the parties and further taking into consideration that the other co- accused assigned the similar role have already been enlarged on bail, therefore, the applicant is entitled to get the benefit of parity. 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Abhishek Saini’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
