Mr. Siddharth Bankoti, learned counsel holding the brief of Mr. Priyanshu Gairola, learned counsel for the applicant through Legal Aid. 2. Mr. Himanshu Sain, learned Brief Holder for the State. 3. Present applicant Deepak, S/o Late Rajendra is praying for bail in relation to S.T. No. 85 of 2024 in which he is facing trial for the offences punishable under Section 64(2)(F) of BNS 2023. 4. The instant bail application has been moved on behalf of the applicant on the basis of his letter which was forwarded by the Jailor of District Jail, Haridwar contending therein that the applicant is languishing in jail since 23.09.2024. 5. Mr. Siddharth Bankoti, learned counsel holding the brief of Mr. Priyanshu Gairola, learned counsel for the applicant on instructions apprise to this Court that the applicant’s father is no more, his mother is blind and he has six sisters and all are married and there is no another member in his family. He further submits that the victim is, in fact, a married lady. He further submits that since charge sheet has already been filed and trial has been commenced, as such, there is no need of custodial interrogation of the applicant. 6. On the other side, Mr. Sain, learned Brief Holder for the State has not disputed that the trial has already been commenced since charge sheet has been filed, and, as such, there is no need of custodial interrogation of the applicant. 7. After hearing the arguments of the 2025:UHC:7174 learned counsel for the parties and further taking into consideration that the applicant is languishing in jail since 23.09.2024 and the trial has already been commenced this Court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 9. Let the applicant Deepak be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned. 10. It is made clear that after being released on bail the applicant shall join the trial court proceedings on each and every date and will not seek unnecessary adjournment.
