JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by the petitioner –accused No.1 under Section 483 of BNSS seeking grant of bail in Crime No.293/2025 of Chitradurga Rural Police Station registered for offences punishable under Sections 310(2) and 311 of Bhartiya Nyaya Sanhita, 2023. 2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent -State. 3. Learned counsel for the petitioner would contend that the petitioner –accused No.1 has been arrested on 16.07.2025. Except car and chilly power, robbed articles are not recovered at the instance of the petitioner. Robbed articles are recovered at instance of three child in conflict with law (CCL). With these, she prays to allow the petition and grant bail to the petitioner –accused No.1. - 3 - HC-KAR NC: 2025:KHC:39993 CRL.P No. 12613 of 2025 4. Per contra leaned High Court Government Pleader for the respondent -State would contend that at the instance of the petitioner –accused No.1 car, knife, chilly power and mobiles are recovered. She submits that offences alleged against the petitioner –accused No.1 are punishable with death or imprisonment for life. The investigation is in-progress and the petitioner is required for further investigation. With these, she prays for dismissal of the petition. 5. Having heard learned counsels, this Court has perused FIR, complaint, remand application and other materials placed on record. 6. The case came to be registered on the complaint filed by one Smt. Devika alias Veena in Crime No.293/2025 of Chitradurga Rural Police Station registered for offences punishable under Sections 310(2) and 311 of Bhartiya Nyaya Sanhita, 2023 against unknown persons. During the investigation, the petitioner –accused No.1 came to be arrested on 16.07.2025. It is alleged in the - 4 - HC-KAR NC: 2025:KHC:39993 CRL.P No. 12613 of 2025 complaint that when complainant was moving in car along with three others, at that time five persons stopped the car threw egg on the glass of the car and robbed gold and silver ornaments. At the instance of the petitioner – accused No.6 car, knife, chilly power and mobiles have been recovered. At the instance of child in conflict with law robbed gold and silver articles are recovered. The investigation is in progress. The petitioner –accused No.1 is required for further investigation. Considering these aspects, the petitioner has not made out grounds for grant of bail. 7.
