02. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.
2. Heard learned counsel for the parties.
3. It is contended that on the face of his long continuance in the establishment of Opp. Party No.3, petitioner is not getting the benefit of regularization, even though a representation has been filed by the petitioner No.1 on 02.08.2025 under Annexure-13, but the same has been kept pending as on date.
3.1. It is accordingly contended that taking into account the long continuance of the petitioner, petitioner’s claim for regularization is covered as per the recent decision of the Hon’ble Apex Court in the case of Jaggo vs. Union of India & Ors., 2024 SCC OnLine SC 3826; Shripal & Anr. vs. Nagar Nigam, Ghaziabad, 2025 SCC OnLine SC
221, as well as Dharam Singh & Ors. vs. State of U.P. & Anr. (Civil Appeal No(s).8558 of 2018.
3.2. Accordingly, it is contended that Opp. Party No.3 be
directed to take a lawful decision on the representation filed by the petitioner to get the benefit of regularization on 02.08.2025 vide Annexure-13 series.
4. Considering the nature of order going to be passed, this Court is of the view that no notice need be issued to O.P. Nos.3 and 4.
5. Having heard learned counsel for the parties and considering the submissions made, this Court while disposing the Writ Petition, directs Opp. Party No.3 to take a decision on the claim of the petitioner so made in his representation on 02.08.2025 under Annexure-13 series, within a period of 2 (two) months from the date of receipt of this order. O.P. No.3 is also directed to take into
consideration the recent decisions of the Hon’ble Apex Court in the case of Jaggo, Shripal and Dharam Singh as cited (supra). Petitioner is permitted to provide a copy of this order along with the decision in the case of Jaggo, Shripal and Dharam Singh before O.P. No.3` for compliance.
6. The Writ Petition stands disposed of.
