ORDER IN CA No.1 & 2 OF 2025 in SCA 7969/2024
1. By way of Civil Application No.1 of 2025, the applicants – heirs and legal representatives of original petitioner (now deceased) have prayed to permit them to be brought on the record of the main Special Civil Application as heirs and legal representatives of deceased petitioner. By way of Civil Application No.2 of 2025, the applicants have prayed for condonation of delay
C/SCA/7858/2024 ORDER DATED: 10/11/2025 of 359 days caused in preferring the application for bringing legal heirs.
3. I have heard learned advocates appearing for the respective parties and perused the contents of the applications. Since suAicient cause is shown by the applicants, Civil Application No.2 of 2025 for condonation of delay stands allowed. Accordingly, Civil Application No.1 of 2025 also stands allowed in terms of prayer 7 (b). Necessary amendment in the cause title of the main Special Civil Application be made forthwith.
ORDER IN SCA NO.7858, 7921, 7932 & 7969 OF 2024 As all these petitions are preferred with similar prayers, prayer made in Special Civil Application No.7858 of 2024 is reproduced which reads as under :-
“a. YOUR LORDSHIPS be pleased to issue a writ of mandamus or a writ in the nature of mandamus or any other appropriate writ, order or direction to command the respondent for taking action as per the representation made by the present petitioner at (“Annexure-A”) to this petition for calculation all his service beneGts, in the interest of justice;”

I have considered the fact that the petitioners are seeking a direction to decide the representation dated 21.9.2023 made by each of the petitioners to the Managing Director of Paschim Gujarat Vij Company Limited which has not been decided till date according to learned advocate for the petitioners and
C/SCA/7858/2024 ORDER DATED: 10/11/2025 learned advocate Mr. Dipak R. Dave appearing for the respondents could not dispute the aforesaid fact. However, learned advocate Mr. Dipak Dave states that appropriate authority to decide the pending representation of each of the petitioners would be General Manager (HR) / Additional General Manager (HR) and though they are not made parties before this Court as Managing Director is a party, learned advocate Mr. Dipak R. Dave has assured the Court that no technical objections about non-joining of General Manager (HR) / Additional General Manager (HR) as parties would be taken by the respondents. Accordingly, the following order is passed :- (i) The General Manager (HR) / Additional General Manager (HR) of the Paschim Gujarat Vij Company Limited is hereby directed to decide the pending representations of each of the petitioners (annexed at Annexure A to each of these petitions) within a period of six weeks from today by passing a reasoned
order, in accordance with law and communicate the decision thereof to each of the petitioners by way of Speed Post.
4. With the aforesaid order, without examining the merits of the matter, all these petitions stand disposed of. Notice is discharged. No order as to costs. Direct service is permitted.
