This writ petition has been filed with the following prayer; "Issue a writ, order or direction, in the nature of mandamus commanding the respondent No.2/Sub Divisional Magistrate, Tehsil Barhaj, District Deoria to pass an appropriate order on the application dated 02.04.2025 filed by the petitioner (Annexure No. 4) for execution of judgement and decree dated 21.11.2024 passed by the respondent No.2 (Sub Divisional Magistrate Tehsil Barhaj, District Deoria) in case No.3657/2021 (Computerized Case No.T2021052004 03657) Ramashankar Vs. Julekha Khaton & others) u/s 144 of U.P. Revenue Code, 2006 with regard to Gata No.10 (area 0.490 hect.) situated in the village Raipura Chaklal Bangar, Tappa Raipura, Pargana Salempur Majhauli, Tehsil Barhaj, District Deoria." 3. Learned counsel for petitioner fairly states that against the judgment passed in proceeding under Section 144 of U.P. Revenue Code, 2006 an appeal under Section 207 of the Code of 2006 has been filed. The said fact has been stated in paragraph no. 5 of the supplementary affidavit, filed today. 4. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondents, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon the authority concerned to decide the appeal No. 2336 of 2024 [Computerized Case No. C-202405000002336] filed under Section 207 of U.P. Revenue Code, 2006, in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 5. With the aforesaid direction, present writ petition stands disposed of. 6. It is made clear that this Court has not adjudicated the case on merit.
