PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused, seeking regular bail, in Crime No.17 of 2025 of Nagari Urban Police Station, Chittoor district. 2 2. A case has been registered against the petitioner herein for the offences punishable under Sections 75(2), 76 of the Bharatiya Nyaya Sanhita, 2023 and Section 9(m) read with 10 of the Protection of Children from Sexual Offences Act, 2012. 3. Case of the prosecution, in brief, is that the victim girl, who is aged about 3 years, is resident of Kavetipuram D. Wada, Nagari Mandal, Chittoor. The incident occurred prior to 20.01.2025 at the house of the accused, who is resident of the same village and he brought the victim girl to his house, disrobed her clothes, took her naked photos and misbehaved with her by touching her body, breast and private parts with sexual intent. Hence, a case has been registered against the petitioner herein. 4. Heard. Perused the record. 5. A perusal of the material on record, prima facie, goes to show that very serious and heinous accusations are attributed against the petitioner herein alleging that he disrobed the clothes of the victim girl, who is aged about 3 years, took her naked photos and misbehaved with her by touching her private parts with sexual intent. It is submitted by the learned Assistant Public Prosecutor that the investigation is not yet completed. This is the second bail application and the earlier bail application filed by the 3 petitioner herein was dismissed by this Court on 06.02.2025. There are no changed circumstances since the dismissal of the previous bail application. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/Accused at this stage. 6.
