Mr. Ankush Singhal, learned counsel for the Applicants. 2. Mr. G.C. Joshi, learned AGA for the State of Uttarakhand. 3. Ms. Rajni Rangwal, learned counsel for the private respondent no.2. 4. In the present C528 of BNSS, 2023, the applicants have put a challenge to the entire proceedings of Criminal Case No.138 of 2024, under sections 323, 498-A and 506 of IPC and under Sections ¾ of the Dowry Prohibition Act, “State Vs. Arun Kumar and another”, pending in the court of learned Civil Judge/Judicial Magistrate, Bazpur, District Udham Singh Nagar. 5. The compounding application (IA No.1/2025) has been filed by both the parties, and this is first date of hearing in the matter for admission. At this juncture, applicant no.1 Arun Kumar (husband of respondent no.2 – Sharti Panthwal) who present before this Court in person along with his respective counsel. State is being represented by learned AGA Mr. G.C. Joshi, and respondent no.2, who is present in person before this Court, is being represented by learned counsel Ms. Rajni Rangwal. Both the parties have made a statement before this Court that they have entered into the terms of compromise and the matter may be compounded, at this stage, on admission itself. They submit before this Court that they do not want to pursue the matter any further against each other, and want to settle their scores amicably. 6. As per records there is a Criminal Case No.138 of 2024, under sections 323, 498-A and 506 of IPC and under Sections ¾ of
the Dowry Prohibition Act, “State Vs. Arun Kumar and another”, pending in the court of learned Civil Judge/Judicial Magistrate, Bazpur, District Udham Singh Nagar, which arose from FIR No.387 of 2023, registered at Police Station – Bazpur, District Udham Singh Nagar. 7. There is a document titled of settlement at page no.38 on the records of the file. The document of compromise as aforesaid bears signature of two witnesses, namely, Sri Vikas Agarwal and Smt. Bharti Devi. Smt. Bharti Devi, is said to be the sister of respondent no.2 Sharti Panthwal and Sri Vikas Agarwal, is the mediator between the parties, who got the matter settled between them. 8.
Keeping in view of the totality of the facts and circumstances of the case, this Court is of the view that ends of justice would be met, if the entire proceedings of Criminal Case No.138 of 2024, under sections 323, 498-A and 506 of IPC and under Sections ¾ of the Dowry Prohibition Act, “State Vs. Arun Kumar and another”, pending in the court of learned Civil Judge/Judicial Magistrate, Bazpur, District Udham Singh Nagar, are hereby quashed. 10. In view of the above, the compounding application is allowed. The entire proceedings of Criminal Case No.138 of 2024, under sections 323, 498-A and 506 of IPC and under Sections ¾ of the Dowry Prohibition Act, “State Vs. Arun Kumar and another”, pending in the court of learned Civil Judge/Judicial Magistrate, Bazpur, District Udham Singh Nagar, are hereby quashed
11. The Criminal Miscellaneous Application, filed under Section 482 of the Code of Criminal Procedure, is disposed of accordingly. (Ashish Naithani, J)
