ORAL ORDER
1. Heard learned advocate Mr.Maulik Nanavati for the petitioner.
2. After arguing for some time, under the instruction of his client, learned advocate Mr.Nanavati does not invite reasons in the matter.
2.1. Nonetheless, learned advocate Mr.Nanavati would request to expedite the trial of the suit inasmuch as it is a money suit filed seeking recovery of Rs.9,50,000/-.
3. Considering such request, which appears reasonable, requires acceptance.
4. When the petitioner is not inviting any reasons in the
C/SCA/13249/2025 ORDER DATED: 19/09/2025 matter, this Court would not like to touch upon the merits of the matter. At the same time, the Trial Court is hereby
directed to expedite the hearing of the Summary Suit No.40 of
2019.
5. If the plaintiff extends her cooperation and support for expediting the trial, the Trial Court is hereby directed to hear and decide the suit as expeditiously as possible on or before
31.12.2026.
6. It goes without saying that any observation so made by the Trial Court while passing the order dated 11.06.2025 would not come in the way of any of the parties and the lis between the parties requires to be adjudicated by the Trial Court as per the evidence coming forth on record of the suit.
7. With the aforesaid observation and direction, the present writ application is disposed of as withdrawn. No order as to costs.
