KVM 2/3 68 - FAST 10641 OF 2021.doc 3) The First Appeal challenges a very meagre amount granted by the Reference Court of Rs.92,592/-. Therefore delay stands condoned and the First Appeal itself is taken up for final hearing. FIRST APPEAL (ST) NO. 10641 OF 2021 4) This First Appeal challenges an judgment and award dated 21 February, 2018 passed by the Civil Judge Senior Division, Nashik in Land Acquisition Reference No. 153 of 2010. 5) The award passed by the Special Land Acquisition Officer (SLAO) on 6 January, 2009 was a meagre amount of Rs.22,320/-. 6) Being aggrieved by the said award, the original claimant preferred reference under Section 18 of the Land Acquisition Act. The Reference Court by its judgment and award dated 21 February, 2018 granted an additional amount of Rs.92,592/- in addition to the amount which was already granted by the SLAO alongwith statutory benefits. The State has challenged the award passed by the Reference Court under Section 18 of the Land Acquisition Act. 7) I have heard learned Additional Government Pleader Mr.Patil for the State and I have gone through the impugned judgment and award dated 21 February, 2018. After going through the impugned judgment and award, I do not find any perversity in the
KVM 3/3 68 - FAST 10641 OF 2021.doc said award. The submissions of the State that the Reference Court erred in allowing the claim and coming to the conclusion that the claimant was entitled to over all market value of Rs.1,22,124/-, I find no merit in the First Appeal.
