Heard learned counsel for the petitioner. 2. This Court on 22.07.2025 passed the following order:- "1. Supplementary affidavit, filed by learned counsel for the petitioner, is taken on record. 2. Learned counsel for the petitioner is directed to implead the Rural Engineering Department, Gorakhpur through Executive Engineer as respondent No.4 during the course of the day. 3. The petitioner by means of the present petition under Article 226 of the Constitution of India has prayed for the following relief:- "(i) issue an appropriate order, direction or writ in the nature of Mandamus restraining the respondents-authorities from raising construction in the form of drainage ditch over the petitioner's land situate at Khata No. 00156, Khasra No. 11M, Village/Mohalla- Mirzapur, Tehsil- Sadar, Tappa- Haveli, District Gorakhpur and from demolishing any part of the petitioner's house No. 154 without following due procedure established in law; (ii) issue an appropriate order, direction or writ in the nature of Mandamus commanding and directing the respondent No. 3 to make proper demarcation of the road (Fal Mandi to Azad Chowk) and thereafter raise construction of drainage ditch in accordance with law without making illegal encroachment over the petitioner's land situate at Khata No. 00156, Khasra No. 11M, Village/Mohalla- Mirzapur, Tehsil- Sadar, Tappa- Haveli, District Gorakhpur." 4. The contention of learned counsel for the petitioner is that the newly added respondent No.4 is raising construction of a drainage by encroaching about 8 feet land of the petitioner in Gata No. 156, situated at Mohalla- Mirzapur, Tehsil Sadar, District Gorakhpur. 5. Sri Sandeep Kumar Singh, learned Standing Counsel is directed to seek instructions within a week and inform the Court as to how the petitioner's 8 feet land is being encroached by respondent No.4 for construction of a drainage without adopting the process of law. 6. Put up as fresh on 4.8.2025. 7. In case the instructions are not received, the Executive Engineer, Rural Engineering Department, Gorakhpur shall appear before this Court along with the record, on the next date of listing." 3. Sri Sandeep Kumar Singh, learned Standing Counsel on instruction states that after the order passed by this Court, respondents have stopped the construction and shall restore the construction only after demarcation of the plot is done. In view of instructions, extracted above, no further order is required to be passed. Accordingly, writ petition is disposed off.
