1. Heard learned counsel for the appellants and the learned Special P.P. for the State.
2. This is an appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the “SC/ST Act”) against the refusal of prayer for anticipatory bail vide
order dated 07.10.2025 in A.B.P. No. 1285 of 2025 passed by the learned 1st Additional Sessions Judge-cum-Special Judge, SC/ST Act, Banka in connection with Anandpur P.S. Case No. 15 of 2025 registered under Sections 126(2), 115(2), 351(2),
Patna High Court CR. APP (SJ) No.4553 of 2025(4) dt.17-08-2026 2/3 352, 3(5) of the BNS as well as Sections 3(1)(r)(s) (w) and 3(2) (va) of the SC/ST Act. 3. Learned counsel for the appellant submits that appellants are persons with clean antecedent and the informant alleges that during immersion of Goddess Saraswati on 04.02.2025 at 7 P.M., accused Sonu blew smoke of cigarette on the face of the niece of the informant, on protest, Santosh abused them by taking caste name and Sonu assaulted Shobha on head causing injury and when Bhikhari Paswan went to save her, when he was also assaulted by Santosh by butt of pistol on head causing injury and thereafter the accused persons fled away. 4. Learned counsel for the appellants submits that appellants have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of abuse or assault is alleged against appellant no.3 i.e. Manish. It is further submitted that it does not appear probable that informant along with her niece on the occasion of immersion of Goddess Saraswati would have been present at the place of occurrence. 5. Patna High Court CR. APP (SJ) No.4553 of 2025(4) dt.17-08-2026 3/3 opposes the prayer for anticipatory bail and submits that informant specifically alleges that Sonu blew smoke of cigarette on the face of her niece and when the same was protested, Santosh abused by taking caste name and Sonu assaulted the informant causing injury on head and when Bhikhari came to save them, he was assaulted by Santosh. It is next submitted that informant specifically alleges that Sonu acted inappropriately with her niece leading to the occurrence. It is further submitted that though no specific allegation is alleged against Manish but then his presence at the place of occurrence emboldened the accused persons to commit the occurrence of inappropriate behaviour and assault at the place of occurrence. 6.
Considering the submissions made by the learned Special P.P., the Court is not inclined to extend the privilege of anticipatory bail to the appellants. 7. The anticipatory bail application of the appellants is hereby rejected. amit/- (Satyavrat Verma, J) U T
