ORAL ORDER (PER: THE HON'BLE MR. JUSTICE S G PANDIT)
This appeal field under Section 19(1) of the Family Courts Act, 1984, is directed against the judgment and decree dated, 18.09.2024, passed in M.C. No.171/2023 on the file of the Principal Judge, Family Court, Bagalkote, whereby the petition filed by the respondent-husband under Section 13(1)(i) and (ib) of the Hindu Marriage Act, 1955 is allowed.
2. Appellant – Smt. Soundarya @ Puttakka Mahantagouda Patil, and the respondent – Sri. Mahantagouda Shekhargouda Patil are present along with their respective counsel viz., Sri. Harish S.Maigur and Sri. Mahantesh R.Patil. The parties are identified by their respective counsel.

Learned counsel for both the parties have filed a Memo, dated 23.04.2025, along with the signature of parties, seeking withdrawal of the appeal. The Memo filed today reads as under:
“That, in the above case, the above matter is settled out of court between the parties. The Appellant/Wife is ready to take Rs.28,00,000/- as

permanent alimony in full and final settlement and having no further claim. The Appellant has received DD of Rs.25,00,000/- through vide DD bearing No.005297, Axis Bank, of Rs.25,00,000/- and the remaining amount of Rs.3,00,000/- will be satisfied by the respondent/husband during the course of the day. Hence, the Hon'ble court may be pleased to dismiss the case by confirming the judgment and decree passed by the Prl. Judge. Family Court, At: Bagalkote in M.C.No.171/2023 dated 18/09/2024 by dissolving the marriage between the Appellant and respondent dated 25/04/2018 held at Shri Sangameshwar Kalyan Matap, Near Basaveshwar Circle, Kudalasangam, Tq: Hungund, Dist: Bagalkot.
Hence this Memo.”
4. Further, learned counsel Sri. Harish S.Maigur for the appellant states that the balance of Rs.3,00,000/- is paid today by way of cash. The same is acknowledged by the appellant who is present before the Court.
5. The Memo is accepted. The appeal is dismissed as withdrawn.
