Neutral Citation No. - 2025:AHC:87497 Court No. - 76 Case :- WRIT - C No. - 22692 of 2024 Petitioner :- Shweta Kumari And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Shailesh Kumar Shukla Counsel for Respondent :- C.S.C. Hon'ble Vinod Diwakar,J.
1. Heard learned counsel for the petitioners, the learned Additional Chief Standing Counsel for the State, and perused the material available on record.
2. In compliance with the previous directions of this Court, both petitioners have appeared in person. Upon interaction, it has been confirmed that they are adults and are residing together voluntarily. The petitioners affirm that they are in a live-in relationship by mutual consent.
3. The father of petitioner no. 1 has also appeared before the Court and submitted that his daughter has allegedly been influenced by petitioner no. 2 through social media interaction. Despite efforts by the family to persuade her to return to the parental home, she has declined to do so.
4. This Court, while recognizing the autonomy and personal liberty guaranteed to individuals under the Constitution, especially to those who have attained the age of majority, observes that every adult has the right to make independent decisions regarding their personal relationships, provided such relationships are consensual and do not contravene any existing law.
5. Upon due consideration of the submissions made and the material on record, there is nothing to suggest that the petitioners are under any coercion, undue influence, or illegal confinement. Further, no specific or credible apprehension has been shown regarding any threat to their life, liberty, or property.
6. In light of the above, this Court is of the considered opinion that no case is made out for exercising the extraordinary writ jurisdiction under Article 226 of the Constitution of India.
7. Accordingly, the writ petition stands dismissed. Order Date :- 28.2.2025 Anil K. Sharma Vinod Diwakar, J. Digitally signed by :- ANIL KUMAR SHARMA High Court of Judicature at Allahabad
