(2) By means of this writ petition, petitioner has sought the following relief: “(i) Issue a writ, order or direction in the nature of mandamus directing the respondents to consider the case of the petitioner for promotion on the post of, In- charge Officer (Pharmacy) in the Medical and Health Department considering the reservation for persons with benchmark disability and not to proceed with the promotion process without applying the reservation for persons with disabilities, on the post of In-charge Officer (Pharmacy).” (3) Learned State Counsel submits that petitioner was earlier serving as Pharmacist in the Medical and Health Department of the State; he was promoted as Chief Pharmacist by giving benefit of reservation available for persons with disabilities, vide order dated 15.7.2011; there are only 14 posts of In- charge Officer (Pharmacy) in the department and Right of Persons with Disabilities Act, 2016 mandates 4% reservation for persons with benchmark disability, out of which 1% each is allocated to specific disability categories. Regarding further promotion to the post 2025:UHC:5915-DB of In-charge Officer (Pharmacy), learned State Counsel submits that petitioner can approach the competent authority by making a representation to Director General, Medical, Health and Family Welfare. (4) Accordingly, we dispose of the writ petition granting liberty to the petitioner to make representation regarding his promotion to the competent authority. If petitioner makes such representation within three weeks from today, decision thereupon shall be taken by the competent authority, as per law, within four months thereafter. (Subhash Upadhyay, J.)
