ORDER This writ petition has been filed challenging the order dated 18.09.2024 passed by the first respondent, thereby directed the petitioner to reside in the Special Camp identified and located by the District Collector, Tiruchirappalli District till the disposal of the case / deportation. 2.The petitioner is a Malaysian national and an individual of Indian origin. The petitioner has been granted the status of Overseas Citizen of India (OCI) by the High Commission of India, vide OCI Card No.A359907, dated
31.12.2019. Therefore, the petitioner can visit India multiple times during his lifetime and he is permitted to stay anywhere in India without any time restriction subject to compliance with Indian laws. While being so, the petitioner while he visited India was implicated as accused in Crime No.01 of 2024 on the file of the sixth respondent for the offence punishable under Sections 419, 420, 468, 471, 120-B IPC and Sections 4 and 20 of the Indian Telegraph Act, 1885. In pursuance to the registration of FIR, the petitioner was arrested and remanded to judicial custody on 19.06.2024. FIR got registered alleging that during the departure of A1 to Malaysia, the Immigration Officer found 22 Indian SIM cards in his possession, without any lawful justification. Subsequently, the petitioner filed bail petition in Crl.O.P.No.22392 of 2024 before this Court and this Court granted bail by order dated 19.09.2024 on certain conditions, however, the petitioner failed to satisfy the learned XI Metropolitan Magistrate, Saidapet, Chennai and the petitioner is still in Central Prison, Puzhal, Thiruvallur District. 3.The learned counsel for the petitioner submitted that during the investigation, passport of the petitioner was seized by the sixth respondent, even then the satisfaction Magistrate insisted the petitioner to produce the passport. In the meanwhile, the first respondent passed the impugned order, thereby
directed the petitioner to reside in the Special Camp identified and located by the District Collector, Tiruchirappalli District. However, the petitioner is still in prison. Whenever the petitioner got released from prison as per the bail
order by satisfying the learned XI Metropolitan Magistrate, Saidapet, Chennai, he cannot be directed to reside in the Special Camp as identified by the District Collector, Trichy. Since the petitioner is Overseas Citizen of India Card holder and as such he can have multiple entries to India and he can stay anywhere in India without any time restriction. 4.In view of the above, if the petitioner comes out from prison, he can stay in his residence in the given address on condition that the petitioner shall https://www.mhc.tn.gov.in/judis

Further, the petitioner shall appear before the trial court on all hearings and the petitioner shall report before the sixth respondent once in a week i.e., every Monday at 10.30 a.m. 5.With the above directions, the writ petition is disposed of.
