THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER
1. The petitioners are before this Court seeking for the following reliefs: (a) Issue any appropriate order or direction or writ in the nature of certiorari by quashing Order passed by the 4th Respondent vide Short-Term Tender Notification No.DCF/TENDER/14/2024-25 dated 16.01.2025 for tree canopy management for the year 2025. 26 and followed by the corrigendum dated 30.01.2025 vide by the issued

No.Hu.Aa.Sam/Tender/P.R./1943/2024-25 Respondents No.2 to 4 as per Annexures A & B respectively.
(b) Grant such other or further relief/s as this Hon'ble Court may deem fit and proper in the facts and circumstances of this case, as an alternative remedy, in the interest of justice and equity.
2. An interim order having been granted earlier, time and time again the respondents have been insisting for the matter to be taken up for hearing. When the petitioners was called upon to address arguments, adjournments had been sought for on the ground that instructions are required.
3. Today, a memo dated 13.11.2025 has been filed by the counsel for the petitioners, which reads as under:
"Memo for Retirement It is respectfully submits as follows: It is submitted that the Petitioners have been duly informed and issued notice to appear and provide necessary instructions / clarification with regard to the above case and despite request and sufficient opportunity given, the petitioners have failed to respond or provide any instructions required for the effective conduct of the case. That due to the continued non- cooperation of the Petitioners, the Undersigned Counsel is unable to proceed further in the matter. Hence, the Counsel humbly prays that this Hon'ble Court may be pleased to permit the undersigned to retire from the above case, in the interest of justice and equity."
4. Along with the said memo, a letter dated 07.11.2025, addressed by the counsel for the petitioners to the

petitioners, has been produced. The said letters have been returned with the endorsement "No such person" and/or "Insufficient address."

Learned counsel for the petitioners today, submit that without instruction he is unable to argue the matter and as such, requested for permission to retire from the above matter. In view of the retirement memo which has been filed and the reason stated therein, the counsel for the petitioners is permitted to retire from the matter and he is discharged from the matter.
6. There being no arrangement having been made for representation of the petitioners and there being no purpose served by issuing a Court notice since the notice issued by the counsel for the petitioners has been returned with the endorsement
"No such persons/Insufficient address." Hence, I am of the considered opinion that there would be no purpose in continuing with the aforesaid petition.
7. Accordingly, the petition is dismissed for non-prosecution.
