Heard Mr. I S Majumdar, learned counsel for the applicant/petitioner and Mr. K Jain, learned counsel appearing on behalf of Mr. S C Keyal, learned Standing counsel, NCB for the opposite party/respondent. 2. In NCB Crime No. 06/2024 registered under Sections 8(C)/21(C) of the NDPS Act, 1985, the applicant/petitioner was arrested on 08.06.2024 as 1200 Nos. of bottles of Eskuf Codeine based cough syrup were recovered from his possession. 3. It is submitted by the applicant that he is suffering from Leukemia and presently undergoing treatment at Dr. B. Borooah Cancer Institute at Guwahati. 4. In the meanwhile, NCB has filed charge-sheet in said NCB Crime No. 06/2024 under Sections 8(C)/21(C)/29 of the NDPS Act, 1985 and the said NCB Crime No. 06/2024 has been re- numbered as Sessions Case No. 412/2024, presently pending before the Court of the learned Additional Sessions Judge No. 3, Kamrup (Metro), Guwahati. 5. It is submitted by the applicant that during his custody in said Sessions Case No. 412/2024 arising out of NCB Crime No. 06/2024 at Central Jail, Guwahati, his father, Ajay Lal
Page No.# 3/4 Gope, son of late Ashwini Kumar Gope committed suicide on 08.02.2025.
As such, he being the eldest son is required to perform certain religious rites for which he has filed this application for his enlargement on bail for a limited period in the interim in said Sessions Case No. 412/2024 arising out of NCB Crime No. 06/2024. 6. Mr. K Jain, learned counsel appearing on behalf of Mr. S C Keyal, learned Standing counsel, NCB stated that for such reasons it has no objection in granting interim bail to the applicant/petitioner for a limited period, but he has to surrender before the authority concerned on completion of the said period. 7. Considering the above, the applicant/petitioner, namely, Mr. Amit Gope, son of late Ajay Lal Gope be released on interim bail in said Sessions Case No. 412/2024 arising out of NCB Crime No. 06/2024 up to 03.03.2025, Monday, on furnishing a bail bond of Rs.1,00,000/-, with 2 (two) suitable local sureties each of the like amount, to the satisfaction of the learned Additional Sessions Judge No. 3, Kamrup (Metro), Guwahati on conditions that the applicant/petitioner – (i) shall surrender before the Superintendent/Jailor of Central Jail at Guwahati by noon (12:00 hours) of 03.03.2025, Monday; (ii) shall submit before the Additional Sessions Judge No. 3, Kamrup (Metro), Guwahati the detail and specific address including the police station to which he shall proceed during this period of interim bail (iii) shall not leave the jurisdiction of the Additional Sessions Judge No. 3, Kamrup (Metro), Guwahati without prior written permission from the said authority; (iv) shall not tamper with the evidence of the case; (v) shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer and (vi) shall not indulge in any offence or any criminal activities in future. 8. Failure on the applicant/petitioner to comply with any of the aforesaid terms and conditions, the interim bail granted to him in the aforesaid Sessions Case No. 412/2024 arising out of NCB Crime No. 06/2024 shall stand automatically vacated. 9.
The learned Additional Sessions Judge No. 3, Kamrup (Metro), Guwahati in said Sessions Case No. 412/2024 arising out of NCB Crime No. 06/2024 shall be at liberty to impose any other condition(s) as it deems fit and proper at the time of releasing the applicant/accused petitioner on bail securing/procuring his attendance during the trial of the said case. 10. On the next date of his Bail Application No. 2032/2024, the applicant shall apprise as to
