HIGH COURT OF JUDICATURE AT ALLAHABAD MATTERS UNDER ARTICLE 227 No. - 7586 of 2025 Court No. - 85 HON'BLE VINOD DIWAKAR, J. 1. Heard learned counsel for the petitioner, learned A.G.A. for the State- respondent, and perused the record. 2. The instant petition has been filed by the petitioner assailing the order dated 19.05.2025 passed by the learned Additional District & Sessions Judge, Court No.11, Saharanpur, whereby the criminal revision preferred by the petitioner came to be dismissed. The relevant portion of the order passed by revisional court is reproduced herein below: "पत्रावली एक्शन प्लान में िचिन्हत है तथा बहस हेतु िनयत है बहस के स्तर पर प्रस्तुत प्राथर्नापत्र के माध्यम से अपीलाथीर्/अिभयुक्त अपने बचाव में जो साक्ष्य उसके द्वारा िवचारण न्यायालय के समक्ष प्रस्तुत नहीं िकया गया है न्यायालय के माध्यम से दािखल कराना चाहता है। 3. Learned counsel for the petitioner submits that the cheque book of the petitioner containing cheque nos. 817001 to 817025 was misplaced. The petitioner lodged an application at Police Station Nakur, District Saharanpur, reporting the loss of cheques. He also approached the concerned bank to stop payment, but the bank assured him of necessary action and returned him with that assurance. Subsequently, on 07.05.2016, one Babu Ram presented cheque no. 817010 for an amount of Rs. 7,80,000/-, which was dishonoured Versus Counsel for Petitioner(s) : Qaisar Kamal Ansari Counsel for Respondent(s) : G.A. Vinit Kumar @ Ashu .....Petitioner(s) State of U.P. and Another .....Respondent(s) for insufficiency of funds. It is further submitted that the petitioner had also moved an application dated 31.03.2016 before the competent authority for calling the account statement of respondent no.2, but without appreciating these facts, the trial court passed the impugned order against the petitioner. It is further contended that the impugned revisional order suffers from perversity and material irregularity in exercise of jurisdiction. 4. Per contra, learned A.G.A., submits that the revisional court has duly considered all submissions and recorded cogent findings while dismissing the revision. It is urged that the present petition is misconceived, filed only with a view to delay the trial, which is already at the stage of final arguments. 5. Having considered the rival submissions and upon perusal of the record, this Court finds that the trial proceedings are at the stage of final arguments. At this juncture, entertaining the present petition would serve no fruitful purpose except to protract the proceedings, which is impermissible in law. 6. In view of the aforesaid, this Court does not find any ground to interfere in the matter. The petition, being devoid of merit, is hereby dismissed. September 16, 2025 Anil K.
