JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioners have filed this writ petition seeking for mandamus directing the respondents to consider the set of representations of the petitioners dated 29.01.2024, 10.02.2025, 06.01.2025, 22.11.2023, 25.01.2024, 02.12.2023 and 29.01.2024 respectively, vide Annexures - H to H6, and to grant one annual increment for the last year of service rendered by the petitioners, and to properly fix their basic pay and to pay all the consequential difference of monetary/retirement benefits. 2. Brief facts leading rise to the filing of the writ petition are as follows: The petitioners retired from the service of the respondent-Corporation, who were relieved from service - 5 - HC-KAR NC: 2025:KHC:52611 WP No. 6777 of 2025 on attaining the age of Superannuation. They have rendered full and continuous year of service before retirement, the increment for the said period has not been sanctioned. They have submitted a representations requesting for sanction of their annual increment for the last year of service rendered by them, and also brought to the notice of the respondents that the order passed by the Hon’ble Apex Court in SLP.No.6185/2020 dated 11.04.2023 is applicable to this case. However, respondent No.2 has not passed any order on the representations submitted by the petitioners. Hence, this writ petition. - 6 - HC-KAR NC: 2025:KHC:52611 WP No. 6777 of 2025 4. Heard the learned counsel for the petitioners and also learned counsel for the respondents. 5. Learned counsel for the respondents submits that, if reasonable time is granted, respondent No.2 would consider the representations at Annexures H to H6 in the writ petition, and would pass an appropriate order in accordance with law. 6. In view of the submission made by the learned counsel for respondent No.2, I proceed to pass the following: ORDER i. The writ petition is allowed. ii. Respondent No.2 is directed to consider Annexures H to H6 of the writ petition in terms of the order passed by the Hon’ble Apex Court in SLP.No.6185/2020 dated 11.04.2023, and pass an appropriate order in accordance with law within 8 weeks from - 7 - HC-KAR NC: 2025:KHC:52611 WP No. 6777 of 2025 the date of receipt of the copy of this order. iii.
