The present application has been preferred for the following relief(s): “for the transfer of Matrimonial Case (Divorce Case) No. 233/2023 pending in the Court of learned Principal Judge, Family Court, Patna to the Court of learned Principal Judge, Family Court, Bhagalpur.” 3. The opposite party-wife has appeared. 4. The contention of the petitioner is that having suffered major car accident in Malaysia and being 89% disabled, he is unable to move out of Bhagalpur. 5. However, upon query, he submits that if video conferencing facility is made available, he has no problem in contesting the matter before the learned Principal Judge, Family Court, Patna. As recorded above, the wife is present through her counsel who submits that if the matter remains in Patna, the lady has no objection if the husband appears through video conferencing. 6. Having heard the parties, this Court is of the opinion that the petitioner has raised first grievance for his appearance through the video conferencing for which the opposite party also have no objection. 7. In the event that the learned Principal Judge, Family Court, Patna, considers the physical presence of the parties necessary for the purpose of mediation, an appropriate order may be passed directing the parties to remain physically present on the particular date fixed for such mediation. 8. Accordingly, granting liberty to both parties to appear either physically or virtually through video conferencing in Matrimonial Case (Divorce Case) No. 233/2023 pending in the Court of Principle Judge, Family Court, Patna. 9.
