For Petitioner(s): Mr.R.Lingesan For Respondent(s): No appearance https://www.mhc.tn.gov.in/judis TR CMP No. 1252 of 2025 __________ Page2 of 6 ORDER This Transfer Civil Miscellaneous Petition has been filed to withdraw the case in I.A.No.512 of 2025 in M.O.P.SR.No.3051 of 2025 on the file of the Family Court, Pondicherry and transfer the same to the VI Additional Family Court, Chennai. 2.Heard learned counsel for the petitioner and perused the materials available on record. 3.Despite the name of the respondent printed in the cause list, there is no representation. 4.Learned counsel for the petitioner submits that the petitioner is residing in Chennai and she filed a petition in O.P.No.2503 of 2025 before the VI Additional Family Court, Chennai seeking annulment of marriage. Subsequently, the respondent filed a petition before the Family Court, Pondicherry, seeking divorce along with filed an application in I.A.No.512 of 2025 and the same is pending. He further submits that it is extremely difficult and burdensome for the petitioner, being a woman, to travel to Pondicherry frequently to attend the Court proceedings. Further, if the above case is not transferred, the petitioner will be put to irreparable loss and hardship. I find merit in the submissions made by the learned counsel for the petitioner. 6.Considering the facts and circumstances of the case, the submission made by the learned counsel for the petitioner and considering the fact that the petitioner is residing in Chennai as well as the connected case is pending before the VI Additional Family Court, Chennai, this Court is inclined to transfer the case on the file of the Family Court, Pondicherry to the file of the VI Additional Family Court, Chennai. Accordingly, the case in I.A.No.512 of 2025 in M.O.P.SR. No.3051 of 2025 is hereby withdrawn from the file of the Family Court, Pondicherry and transferred to the file of the VI Additional Family Court, Chennai. After receipt of the case papers from the Family Court, Pondicherry, the VI Additional Family Court, Chennai is directed to send a notice to the respondent within four weeks.
