AGAINST THE PETITIONERS NO. 1 TO 15/ACCUSED NO.1, 4, 5, 6, 7, 8, 9, 10, 12, 13, 14, 15, 16, 17 AND 19 AND ETC., THIS CRIMINAL PETITION IS COMING ON FOR ADMISSION THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 4 - NC: 2025:KHC-D:2161 CRL.P No. 103514 of 2024 ORAL ORDER (PER: THE HON'BLE MR. JUSTICE SURAJ GOVINDARAJ) 1. The petitioners are before this Court seeking for the following reliefs; 1. Quash the C.C.No. 439/2017 (Khadebazar Police Station Cr.No. 71/2016) which is pending before the III J.M.F.C. Court Belagavi for the alleged offences P/U/Sec.143, 145, 341 r/w 149 of IPC and Sec.103 of K.P.Act against the petitioners No.1 to 15/accused Nos.1, 4, 5, 6, 7, 8, 9, 10, 12, 13, 14, 15, 16, 17 and 19. 2. Grant such other relief or reliefs as this Hon’ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity. 2. The proceedings which have been initiated against the petitioners’ is on account of violation of the orders passed by this Court in WP No.103238-39/2016 and WP No.103135/2017 dated 12.04.2016. 3. The respondent-State initiated the aforesaid proceedings on account of the violation of the orders and the undertaking furnished by the Belagavi City Ramanavmi Utsav Samiti. As per the say of the respondent, it is required for trial to be held and this Court cannot at this stage quash proceedings on the - 5 - NC: 2025:KHC-D:2161 CRL.P No. 103514 of 2024 allegation that the petitioners have been randomly selected and arrayed as accused. 4. It is for the prosecution to establish the involvement of the petitioners in the offences as alleged against the petitioners and on mere say of the petitioners that they were not involved and they have been randomly arrayed as accused, cannot be accepted by this Court at this stage. 5. No grounds being made out, the petition stands dismissed. 6. In view of disposal of the writ petition, pending interlocutory applications, if any, do not survive for consideration and are disposed of accordingly.
