At the very outset, Sri Firoz Haider, learned counsel for the applicant seeks to withdraw the present application wherein the challenge has been raised in the summoning order dated 15.03.2021 passed by Metropolitan Magistrate, Room no. 08, Kanpur Nagar as well as entire proceeding of the Complaint Case no. 799 of 2020 (Moin Rahman versus Syed Mohammad Haider), under section 138 Negotiable Instrument Act, on account of incurable technical defects with liberty to file afresh. 2. Learned AGA and learned counsel for the opposite party no. 2 have no objection to the same. 3. The application is dismissed as withdrawn with liberty aforesaid. 4. Certified copy be returned subject to submission of photocopy. 5.
