Serial No.31 SUPP LIST IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR WP (C) No. 1297/2025 FAROOQ AHMAD SHEIKH …Petitioner/Appellant(s) Through: Mr. Areeb Kawoosa, Advocate Vs. UNION OF INDIA AND OTHERS ...Respondent(s) Through: Mr. T.M. Shamsi, DSGI with Ms Yasmeen Jan, Advocate Ms Kainaat Mushtaq, Advocate vice Mr. Umar Rashid, Advocate CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDE R 04.06.2025 The short grievance projected by the petitioner in this petition is that an assessment order for the assessment year 2019-20, dated 14th March, 2024, passed by the Assessment Unit of Income Tax Department, has been assailed by the petitioner by way of a statutory appeal filed before the Appellate Authority on 16th April, 2024. It is submitted that more than one year has passed, the Appellate Authority has not been able to dispose of the appeal. It is further submitted that the Income Tax Authorities are issuing demand orders without awaiting the disposal of the appeal. Be that as it may, in the given facts and circumstances of the case, and regard being had to the nature of the relief prayed for, this petition is disposed of with a direction to the Appellate Authority to take up and dispose of the appeal preferred by the petitioner with reasonable dispatch. Till the appeal is taken up and disposed of by the Appellate Authority, there shall be a stay of the impugned assessment order and all consequential proceedings. Disposed of.
