Neutral Citation No. - 2025:AHC:77963-DB Court No. - 29 Case :- SPECIAL APPEAL No. - 786 of 2024 Appellant :- Mandan Mishra Respondent :- Electric Service Commission And Another Counsel for Appellant :- Ram Dutt Mishra,Sunil Kumar Singh Counsel for Respondent :- Abhishek Srivastava Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J. Learned Single Judge has rejected the claim of appellant for appointment on the post of Technician Grade-II, after noticing that the petitioner did not possess requisite qualification for appointment to the post. The advertisement is at page 56 of the paper book, which specifies the requisite qualification for appointment to the post of Technician Grade-II (Trainee) Electrical. The qualification is passing of High School or equivalent examination with Science and Mathematics in addition to ITI certificate on Electrician Trade. The appellant has passed High School from Sanskrit Board in which his subjects are mainly Sanskrit and Hindi. He has opted for two alternative subjects i.e. Literature and Science. The additional subject opted by the appellant is English. The High School certificate issued by the Sanskrit Education Board does not show that appellant has passed High School with Mathematics as one of the subjects. The argument that Mathematics was included in Science has not found favour with learned Single Judge. Having gone through the records, we find ourselves to be in agreement with the view expressed by learned Single Judge, inasmuch as Mathematics once is shown to be one of the subjects required to be possessed by the candidate in the High School Examination and appellant has not opted for such subject, as is clearly reflected from his High School Certificate, we would not be justified in embarking upon a factual exercise to examine the syllabus and come to the conclusion that Mathematics as a subject is included in Science. Special appeal, accordingly, is dismissed. Order Date :- 13.5.2025 Anil Digitally signed by :- ANIL KUMAR PATEL High Court of Judicature at Allahabad
