Neutral Citation No. - 2025:AHC:140606 Court No. - 52 Case :- WRIT - A No. - 10119 of 2025 Petitioner :- Rani Devi Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Mehendra Kumar Gautam Counsel for Respondent :- C.S.C.,Rameshwar Prasad Shukla Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Mehendra Kumar Gautam, learned counsel for the petitioner, Mr. A.K. Saxena, learned counsel for the respondent no.5, Mr. Rameshwar Prasad Shukla, learned counsel for the respondent no.7 and learned Standing Counsel for the State- respondents. The instant writ petition has been preferred with a prayer to direct the respondents to work on original post of Rasoiya/cook and pay to salary/mandeya with all benefits of the petitioner in service and a further prayer to direct the respondents to decide the representation of the petitioner dated 12.04.2024.
Learned counsel for the petitioner submits that the petitioner was appointed as Rasoiya/Cook in October, 2012 as per the relevant Government Order dated 24th April 2010. It appears that she was sent to jail in some matter in the year 2023, after which she was not permitted to join her duties. Therefore, she has moved an application before the respondents to consider her claim for payment of salary with all benefits, but nothing has been done till date. On the basis of instructions, learned counsel for the respondents informs that the petitioner worked up till 2021, after which she has not been permitted to continue due to some criminal case against her for which she was sent to jail. Therefore, nothing is due as she had worked only up to 2021. Even otherwise, as per the relevant Government Order, an appeal lies if the petitioner is aggrieved by the same. In view of the above, the present writ petition is misconceived and it is, accordingly, dismissed.
