Heard learned counsel for the appellant, learned Special P.P. for the State and the learned counsel appearing on behalf of the informant. 2. This is an appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the “SC/ST Act”) against the refusal of prayer for anticipatory bail vide order dated 16.07.2025 in A.B.P. No.1533/2025 passed by the learned 11th Additional District and Sessions Judge-cum-Special Judge S.C./S.T. (POA) Act, Gopalganj in connection with Uchkagaon P.S. Case No.123 of 2024, registered for the offences punishable under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code as well as Sections 3(1)(r)(s) of the Patna High Court CR. APP (SJ) No.3190 of 2025(6) dt.18-08-2026 2/3 SC/ST Act. 3. Learned counsel for the appellant submits that appellant is a person with clean antecedent and the informant alleges that a quarrel ensued in between his minor grandson and minor grandson of Balister Baitha, his agnate, hence he went to the house of Balister Baitha to complain, when Balister started abusing and assaulted by lathi causing fracture of shoulder, thereafter named accused persons including the appellant and women accused caught the informant and Balister again assaulted by farsha causing injury on head and thereafter again repeated the blow causing injury on back side of the head and the informant became unconscious. 4. Learned counsel for the appellant submits that appellant has been falsely implicated in the instant case by the informant being neighbour of Balister. It is further submitted that from side of Balister Uchkagaon P.S. Case No.124 of 2024 has been instituted against the informant and his side. It is further submitted that appellant being neighbour of Balister side with him hence he came to be implicated with an allegation that he along with other accused persons caught the informant and Balister assaulted. It is further submitted that the entire occurrence is alleged to have taken place at the house of Balister Patna High Court CR. APP (SJ) No.3190 of 2025(6) dt.18-08-2026 3/3 and thus was not in public view. 5. Learned Special P.P. for the State and the learned counsel appearing on behalf of the informant opposes the appeal. 6. In view of the submissions made by the learned counsel for the appellant, the appellant above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor court in connection with Uchkagaon P.S. Case No.123 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS. 7. Accordingly, the appeal stands allowed. amit/- (Satyavrat Verma, J) U T
