This captioned petition is filed by the husband seeking quashing of the proceedings pending in Crime No.24/2025 registered for the offences punishable under Sections 85, 351(2) and 352 of the Bharatiya Nyaya Sanhita (BNS), 2023. 2. Heard the learned counsel for the petitioner, learned Addl.SPP for respondent No.1 and learned counsel for respondent No.2. Perused the records. - 3 -

3. Today, an affidavit of respondent No.2/complainant is placed before this Court. In the said affidavit, respondent No.2/complainant acknowledges that the matrimonial disputes between her and petitioner No.1 have been amicably settled and given a quietus. In view of the settlement, respondent No.2/complainant has undertaken to withdraw the complaint which led to the registration of Crime No.24/2025. The affidavit filed by respondent No.2/complainant is taken on record. 4. At paragraph No.6 of the affidavit, respondent No.2/complainant has made an unequivocal declaration that she does not wish to pursue the complaint dated 04.03.2025. The said paragraph reads as under:
"6. I, Smt. Simran Oberoi, the Respondent No.2 herein, state that in the light of the settlement between Petitioner No.1 and myself, I am not desirous of pursuing the matter arising out of my Complaint dated 04.03.2025, registered by the Respondent No.1 police in Crime No.24/2025 for offences punishable under Sections 85, 351(2), and 352 of the Bharatiya Nyaya Sanhita, 2023, against the petitioner herein, for which the present petition seeking quashing has been filed."

5. On being queried by this Court, respondent No.2/complainant has confirmed that the disputes have been amicably resolved as set out in the affidavit filed today. 6. On verification and being satisfied that the withdrawal of the complaint by the wife is voluntary and arises out of a genuine settlement of matrimonial disputes, including those under the Guardians and Wards Act, 1890, this Court is of the view that the complaint dated 04.03.2025, which led to registration of Crime No.24/2025, deserves to be compounded. The dispute being purely personal in nature between husband and wife, and the alleged offences being in the context of matrimonial discord, this Court is inclined to permit compounding in terms of the affidavit of respondent No.2/complainant. 7.
Both learned counsels, on instructions, have orally submitted that all allegations made in the present petition as well as in the connected matrimonial proceedings stand mutually withdrawn. - 5 -

8. In light of the affidavit placed on record, the following:
ORDER (i) The petition is allowed. (ii) The proceedings in Crime No.24/2025, registered for offences punishable under Sections 85, 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023, by the East Women Police Station, Pulakeshinagar Sub-Division, Bengaluru City, and pending before the Court of the 11th Additional CMM, Mayohall, Bengaluru City, are hereby quashed insofar as the petitioner is concerned.
