Neutral Citation No. - 2025:AHC:122458 Court No. - 5 Case :- WRIT - A No. - 10425 of 2025 Petitioner :- Satiram Respondent :- Uttar Pradesh Cooperative Bank Limited And 3 Ohters Counsel for Petitioner :- Manoj Kumar Srivastava Counsel for Respondent :- C.S.C.,Satyam Singh Hon'ble Saurabh Shyam Shamshery,J. Heard Sri Manoj Kumar Srivastava, learned counsel for petitioner and Ms. Anju Yadav, holding brief of Sri Satyam Singh, learned counsel for respondent. The petitioner has rushed this Court only at the stage of issuance of a notice dated 25.04.2025, whereby petitioner was directed to increase recovery, since it remained very short of targeted recovery with further observation that in case of default, a strict action may be taken against him. Learned counsel for petitioner on basis of instructions fairly submits that till date no adverse has been passed and petitioner has submitted a reply, explaining the reasons for not achieving target of the recovery. Learned counsel for respondent submits that on basis of contents of impugned notice, since no action has still been taken or no adverse order is passed, therefore, this writ petition may be rejected being not maintainable. I have considered the above submissions and taking note of undisputed facts that on basis of aforesaid referred impugned notice till date, no action has been taken against petitioner and no adverse order was passed, therefore, this writ petition is dismissed being premature.
