DATE : 4th NOVEMBER, 2025 P.C:- 1) The Petitioner is aggrieved by the perfuntory and lackadaisical approach of the Investigating Agency in investigating FIR No.I-341 of 2016 registered with Nagpada police station and subsequently, investigated by E.O.W, Crime Branch, Mumbai. The relief sought in the Petition is to conclude the investigation within such measurable time as this Court deem fit and appropriate. The Petition also seek a relief of initiating action against the Senior Police Officials, who are responsible for scuttling the investigation. 2) The learned A.P.P. Mr.Agarkar has placed before us the report received by him on 4/11/2025 which disclose that on completion of HEMANT CHANDERSEN SHIV Digitally signed by HEMANT CHANDERSEN SHIV Date: 2025.11.11 10:12:47 +0300 hcs 2/2 28.w2839.18.doc investigation, the charge-sheet has been filed before the J.M.F.C. 6th Court, Thane and it is allotted R.C.C. No.104 of 2023. It is informed that the proceedings are pending against the three accused persons who have been released on bail on 6/01/2023 and the next date in the proceedings is 30th December, 2025. 3) In the wake of the aforesaid development in the matter, we are not inclined to entertain the Petition but we can only observe that since the FIR is registered in the year 2016 and the charge-sheet is now filed, we expect the learned Magistrate to complete the trial in an expeditious manner, considering the fact that the FIR is of the year 2016. 4) With this direction, the Petition is disposed of.
