ORAL ORDER
Both the petitions arise out of Crime No.11/2025 of Bengaluru District Women Police Station, registered on a complaint lodged by respondent No.2 against accused Nos.1 to 5 for the offence punishable under Section 85, 115(2), 352, 190 of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 3 and 4 of the Dowry Prohibition Act, 1961. 2. Investigation is completed and the charge sheet is filed. Petitioner in Crl.P.No.10258/2025 is accused No.1 and petitioners in Crl.P.No.9167/2025 are accused Nos.2 to 5 respectively. 3. In both the petitions, applications are filed under Section 359 read with Section 528 of the BNSS, 2023, reporting settlement, accompanied by the joint affidavit of the parties. 4. It is stated that the parties have mutually agreed to resolve the issue and in view of the settlement, accused No.1 and respondent No.2 have agreed to withdraw all the cases filed against each other. - 6 -

5. Para-1 to 8 of the applications filed in both the petitions, which are identical, are extracted hereunder:
"The petitioner and respondent No.2 jointly submit before this hon'ble court as follows:
1. The respondent No.2 has lodged a complaint before the Respondent No.1 police which came to be registered as Crime No.11/2025 by the Doddaballapura Women Police, Bengaluru District and further charge sheet was filed against the petitioners in C.C.No. 2325/2025 on the file of Addl. Civil Judge & JMFC, Doddaballapura registered under sections 85, 115(2), 352, 190 of The Bharatiya Nyaya Sanhita (BNS), 2023 and section 3 and 4 of Dowry Prohibition Act, 1961. 2. The Accused No.1 and Respondent No.2 admit the relationship of husband and wife, their marriage was solemnized on 10.06.2022. 3. The Petitioner and Respondent No.2 have mutually agreed between themselves and further they have resolved by way of KHULA DATED.18.11.2025. 4. Due to irreconcilable differences and incompatibility of temperaments, the Petitioner and Respondent No. 2 are living separately since May 2023. The efforts made by the elders, friends and well-wishers to resolve the differences between the Petitioner and Respondent did not yield any fruits. There is absolutely no chance of reunion amongst them.

5. In view of the settlement of the Petitioner and Respondent No.2 they have agreed to withdraw the all the cases filed against each other and also agreed to withdraw the below mentioned cases
6. The Petitioner and Respondent No.2 state that, apart from the above, they have no claims of whatsoever nature against each other and also in respect of movable/immovable properties belonging to each other. 7. The Petitioner and Respondent No.2 undertake that, they shall not interfere with the life of each other in future. 8. In view of the aforesaid agreement entered into between the parties, the parties pray that this Hon'ble court be pleased to pass the necessary orders as prayed for in the above petition. 6. The matter arises out of a matrimonial dispute, wherein the parties have filed applications reporting settlement, supported by their affidavits. Petitioners as well as respondent No.2 are present before the Court. They are identified by their respective counsel. - 8 -

7. Respondent No.2 submits that in view of the settlement, she is not interested in pursuing the matter any further and she has no objection to quash the proceedings. 8. In B.S.Joshi and others V. State of Haryana and another reported in (2003) 4 SCC 675, the Hon'ble Supreme Court has upheld the powers of the High Court under Section 482 of the code to quash criminal proceedings, where dispute is of a private nature and the compromise is entered into between the parties. 9. In view of the above facts and circumstances, no useful purpose will be served in keeping the proceedings pending before the trial Court. In order to secure the ends of justice, it is just and proper to quash the proceedings as prayed. Accordingly, the following:
ORDER (i) Applications are allowed. Consequently, petitions are allowed;
(ii) The entire proceedings in C.C.No.2325/2025 on the file of the Court of Additional Civil

Judge and JMFC, Doddaballapura, are quashed.
