The case of the petitioners is that old Gata No. 191-Sa, new Gata No. 141-Ka was allotted in favour of their ancestor and now they are in possession of the same. An internal communication dated 10.1.2025 by Regional Forest Officer, Jai Mohani Range addressed to Additional Director, Resham, Naugarh, Chandauli, is under challenge on the ground that therein name of the petitioners has been wrongly mentioned as encroachers of the forest land. It is submitted that on the basis of said internal communication, the department has lodged FIR against the petitioners and is now threatening to dispossess them. Learned counsel for the petitioners submits that the petitioners have submitted a detailed representation to the District Magistrate and he prays that it may be directed to be decided. 2. Since it appears that action is being taken by the forest officer treating the said land as forest land, therefore, we dispose of the instant petition with liberty to the petitioners to represent before Divisional Forest Officer- respondent no. 3, herein, within two weeks alongwith true attested copy of the instant order, and in which event, he will decide the same by a speaking order within next three weeks and until then, no coercive action shall be taken for dispossession of the petitioner, if already not dispossessed. 3.
