It is submitted on behalf of the petitioner that petitioner's husband was died in harness, consequently, petitioner was permitted to retain the official accommodation. However, subsequently, pursuant to the notice she has vacated the official accommodation on 31.03.2024 but the deductions have been directed for the recovery of penal rent. 2. In the given facts and circumstances, this petition stands disposed of with a direction to respondents that petitioner's husband died in harness, she being a widow was directed to retain the official accommodation, it is hereby provided that only regular rent shall be recovered from the petitioner and not the penal rent for the period petitioner occupied official accommodation which otherwise her husband has paid as an employee of the respondent establishment while in service. 3. The order dated 04.04.2024 in the special facts and circumstances, is hereby quashed, however, shall not be a binding precedent. Order Date :- 24.7.2025 S.A.
