ORAL ORDER Aggrieved by the
order passed in I.A.No.8 in Crl.Misc.No.263/2019 dated 11.11.2025 by the II Addl. Principal Judge, Family Court, Bengaluru, whereby the Family Court had dismissed I.A.No.8, the husband is before this Court.
2. It is the case of the petitioner/husband that the Crl.Misc. is of the year 2019. I.A.No.8 was filed by the husband seeking to reopen the case for further evidence. The Family Court by order impugned had dismissed the I.A. and observed that both the parties and their respective learned counsels were absent. There was no representation for respondent and his
learned counsel. This matter was kept by and again called at 3.33 pm, when once again both the parties and their respective learned counsels were absent. Therefore, in view of the observations made in the last date order, I.A.No.8 was dismissed.

Learned counsel for the petitioner submits that the petitioner may be given an opportunity to adduce further evidence.

4. Having heard the learned counsel appearing for the petitioner, perused the material on record. When the Crl.Misc. is filed in the year 2019, the petitioner cannot be permitted to reopen the case at this stage and the Family Court was right in dismissing the I.A. particularly in the light of the fact that there is no representation. This Court do not find any reasons to interfere with the order impugned passed by the Family Court. Hence, this Court is passing the following:
ORDER i. Accordingly, the writ petition is dismissed. ii. All I.As., in the writ petition shall stand closed.
