Hon'ble Sanjay Kumar Singh,J. 1-Heard learned counsel for the applicant and learned Additional Government Advocate representing the State of U.P. 2-The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No. 95 of 2025, under Sections 309(4), 317(2) B.N.S. and Sections 3/25 Arms Act, Police Station Bahriya, District Prayagraj, during the pendency of trial. 3-As per the prosecution case in brief, complainant- Shashi Kumar Mishra has lodged an F.I.R. on 20.05.2025 for the alleged offence under Section 309(4) B.N.S., 2023 against unknown person alleging inter-alia that he is an employee in Mahindra Kotak Bank. On 20.05.2025, due to some official work, he came to the house of Shailesh Kumar, situated at Prayagraj. After the collection, he has total collection of Rs. 85,700/-. F.I.R. also alleges that when he was returning, two unknown persons came on a motorcycle and snatched his bag which contains the collected money, his mobile phone and I.D. card. 4-It is argued by learned counsel for the applicant that during investigation, co-accused Sumit Bhartiya and Sahil were apprehended by the police on 23.05.2025 and from their possession, Rs. 16,500/- and Rs. 9,500/- were recovered respectively. It is next submitted that on an interrogation, they have disclosed the name of four persons, namely, Ravi Patel @ Ajay Patel (applicant), Ayaditya Singh, Sooraj Pal and Sachin Yadav. Thereafter, they all have been apprehended by the police on 27.05.2025 and police shown a recovery of Rs. 20,000/- cash, one country made pistol, one live cartridge and keypad mobile phone from the possession of the applicant. Much emphasis has been given by contending that the applicant has been falsely implicated in this case. The investigation has been completed and till date, there is no recovery of alleged mobile phone of the complainant. It is also pointed out that Sumit Bhartiya, in whose statement, complicity of the applicant came into light, has been granted bail by the co-ordinate Bench of this Court vide order dated 04.08.2025 in Criminal Misc. Bail Application No. 25671 of 2025.
