We have also perused the joint memo entered into which is signed by the appellant as well as both the respondents. - 3 - HC-KAR NC: 2025:KHC:25488-DB RFA No. 2069 of 2023 3. Today, both the parties are present before this court and are duly identified by the learned counsel appearing for them. It is submitted that both the parties have entered into an M.O.U and they have agreed to sell the suit schedule property excluding the property already sold by the appellant in favour of the third party and have agreed to divide the sale consideration in accordance with the terms of the M.O.U. The M.O.U has also been placed before us which contains the details of their shares. 4. The joint memo along with the M.O.U is accepted on record. 5. The compromise entered into between the parties is duly recorded. The Judgment and Decree under appeal is set aside. The appeal is decreed in terms of the M.O.U entered into between the parties. The parties shall abide by the same. 6. Accordingly, the appeal is disposed of. - 4 - HC-KAR NC: 2025:KHC:25488-DB RFA No. 2069 of 2023 Registry to draw the decree accordingly, in terms of the M.O.U.
