JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER This petition is filed by accused No.8 seeking quashing of the criminal proceedings pending in C.C.No.30852/2021 on the file of the VI Additional Chief Metropolitan Magistrate, Bengaluru City, for the offences punishable under Sections 420 and 406 of the Indian Penal Code. The primary contention urged by the petitioner is that he is in no way connected with the alleged commission of the offences and that the continuation of

At this stage, learned High Court Government Pleader has placed on record a report submitted by the Investigating Officer. A perusal of the said report reveals that during the course of investigation, the role of accused No.8 was re-examined and it has now been clarified that the present petitioner has been cited as a prosecution witness (C.W.8) in the charge-sheet. Consequently, his name has been deleted from the array of accused in the final report filed before the competent Court. In view of the categorical statement made by the learned HCGP, and having regard to the fact that the petitioner is no longer shown as an accused in the charge- sheet but has instead been cited as a prosecution witness, this Court is of the opinion that the petitioner cannot be subjected to further proceedings in C.C.No.30852/2021 insofar as his alleged role as accused No.8 is concerned.
