The jurisdiction of this Court under Section 226 of the Constitution of India has been invoked for issuing a Writ in the nature of Habeas Corpus for appointment of a Warrant Officer for the release of the detenue, namely, Suhalia d/o petitioner, stated to be in illegal confinement of respondents No.4 and 5. 2. Vide order dated 19.12.2025, this Court directed respondent No.2-Senior Superintendent of Police, Malerkotla to ensure presence of detenue before learned Chief Judicial Magistrate, Malerkotla for recording of her statement. It was further ordered that in case, she (detenue) was illegally detained by respondents No.4 and 5 and she expressed her willingness to go with the petitioner, she may be permitted to do so. 3. Report of learned Chief Judicial Magistrate, Malerkotla has been received. As per report, alleged detenue appeared before the Court and stated that she wants to live with her husband-Shiv Kumar. She further stated that she was threatened by her parental family and she did not want to go with petitioner-Shokat Ali.
