Petitioners are an organization namely, Madrasah Teachers Association Represented by their President and the petitioner no. 2 is a member of the said organization/teacher. They applied before the administration for a sit-in demonstration. However, they have received a communication from the Joint Commissioner of Police Headquarters for such sit-in demonstration for 50 participants. Mr. Firdous Shamim appearing for the petitioner prayed for 10 day’s continuous sit-in demonstration, on the other hand, Mr. Basu Mallick opposed the same and submitted that only one day demonstration has been allowed. 2 Since the petitioners had applied earlier and their demonstration was stalled pursuant to the request made by this court, I direct that the petitioners may be allowed to hold their sit-in demonstration at College Square facing Bankim Chatterjee Street between 11.00 a.m. to 8.00 p.m. on and from 01.05.2025 to 05.05.2025. Since the petitioners had by a disciplined manner stalled their demonstration pursuant to the request made by this court, KMC authorities are directed to give necessary permission for such demonstration. Police authorities would ensure that the security in and around the locale of such demonstration is peacefully monitored, maintained and the petitioners, on the other hand, will furnish the name of at least 5 organiser’s along with their phone numbers to the police authorities so that at the time of crisis both can co-ordinate to dissuade the same. The demonstrators would maintain the decibel limit fixed by the West Bengal Pollution Control Board and would ensure that the nearby school, colleges and hospital, if any, be not disturbed by the sound emitted from the microphones. Two microphones may be used by the 3 demonstrators for speech and other programmes, if any, to be conducted by the said organization. With the aforesaid observations WPA 2094 of 2025 is disposed of.
