JUSTICE MOHAMMAD NAWAZ ORAL ORDER This petition is preferred under Section 483 of the BNSS, 2023 by accused No.3 in Crime No.416/2025 of Marathahalli Police Station, Bengaluru City, seeking to enlarge him on bail. 2. FIR is registered against accused Nos.1 to 3 for the offence punishable under Sections 351 and 64 r/w section 3(5) of the BNS, 2023. 3. The learned Sessions Judge, vide order dated 04.08.2025 in Crl. Misc. No.6044/2025, rejected the bail petition of the petitioner. It is observed therein that investigation is still pending and the statement of the Prosecutrix is yet to be recorded under Section 183 of the BNSS, 2023. 4. The learned counsel for petitioner submits that petitioner may be permitted to withdraw the petition, with liberty to approach the Sessions Court, once the charge sheet is filed. 6. In light of the above submissions, petition is dismissed as withdrawn, reserving liberty to the petitioner to file a fresh bail application before the Sessions Court after filing of the charge sheet. 7.
