JUSTICE R DEVDAS ORAL ORDER This writ petition is filed by the petitioner, who is a Nigerian national and had come to India on a student visa during October 2019, for the purpose of studying Bachelor of Computer Application (BCA) in the respondent No.2- Institution. 2. The petitioner contends that in the year 2020, she completed the requirements for the award of internal assessment for second semester of BCA and in fact, the Institution had awarded the marks for internal assessment. However, due to the outbreak of COVID-19 pandemic and the subsequent lockdown, the second - 3 - HC-KAR NC: 2025:KHC:35818 WP No. 23983 of 2025 semester examination which was scheduled to be held during May-June 2020 was indefinitely called off. The first respondent thereafter issued a notification towards the payment of examination fee for the second semester examination. 3. Learned Counsel for the petitioner submits that the first respondent-University or the second respondent- Institution cannot deny the fact that the awarding of marks in the second semester was on the basis of the marks obtained in the internal assessment and no examinations were held. The grievance of the petitioner was regarding the collection of examination fee. However, the learned Counsel submits that the issue now is regarding the marks card and the fee which is sought to be collected by the second respondent for issuance of marks card. 4. Today learned Counsel for respondent No.1 submitted before this Court that the marks card of the petitioner is ready and the same will be forwarded to the - 4 - HC-KAR NC: 2025:KHC:35818 WP No. 23983 of 2025 second respondent-Institution and the petitioner has to collect the same from the second respondent-Institution. 5. Having regard to the facts narrated hereinabove, the writ petition stands disposed of, with a direction to the second respondent-Institution to furnish the marks card that would be given by the first respondent-University to the petitioner. The marks card shall be handed over by the second respondent to the petitioner within two days from the date when which the first respondent-University furnishes the marks card to the second respondent- Institution. If the second respondent has any further grievance, regarding fee towards marks card, it may approach this Court by filing an application but the marks card shall be tendered to the petitioner forthwith.
