1. Heard learned counsel for the petitioners and State.
2. Instant petition under Section 483 BNSS is filed for release of the petitioners on bail in connection with 2(a) C.C. Case No.15 of 2024 corresponding to OIC, Bhanjanagar Excise Station P.R. No.108 of 2024-25 pending in the file of learned Additional Sessions Judge-cum-Special Judge, Bhanjanagar on the grounds stated therein.
3. Perused the P.R. and the rejection order as at Annexures-1 and 2 respectively.
4. The Court finds that the petitioners are local and not outsiders and in so far as the recovery is concerned, it relates to 28 Kgs of contraband Ganja. Mr. Bose, learned counsel for the petitioners submits that both the accused persons are first-time offender having no other similar antecedents. Recorded the objection of Mr. Jena, learned AGA for the State. The recovery and seizure is in respect of commercial quantity of Ganja. However, having regard to the claim that there is absence of any antecedents
of similar nature, the Court is inclined to grant them bail, however, with stringent conditions.
5. Accordingly, it is ordered.
6. In the result, the petition under Section 483 BNSS stands allowed. Consequently, the petitioners are directed to be released on bail in connection with 2(a) C.C. Case No.15 of 2024 arising out of P.R. Case No. 108 of 2024-25 subject to them furnishing bail bonds of Rs.40,000/-(rupees forty thousand) each with one solvent surety for the like amount to the satisfaction of the learned Additional Sessions Judge-cum-Special Judge, Bhanjanagar, who shall impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall attend the P.S. once in a month and shall furnish an undertaking at the P.S. concerned not to commit similar offences after being released. The release of the petitioners shall also be subject to absence of similar antecedents.
7. The BLAPL is disposed of.
8. Urgent certified copy of this order be granted as per rules.
