Neutral Citation No. - 2025:AHC:117776-DB Court No. - 40 Case :- WRIT - C No. - 23316 of 2025 Petitioner :- M/S Alipur Filling Station Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Akshay Gupta,Brijesh Kumar Verma Counsel for Respondent :- C.S.C. Hon'ble Saral Srivastava,J. Hon'ble Kshitij Shailendra,J.
1. Heard learned counsel for the petitioner and Ms. Priyanka Midha, learned Standing Counsel for the State-respondents.
2. By means of this writ petition, a show cause notice dated 26.05.2020 has been challenged.
3. Latches of about 1786 days have been reported by the Stamp Reporting Section. Latches have been explained in paragraph 18 of the writ petition which is reproduced as under:
"18. That the delay for challenging the show cause notice 26-05-2020 passed by District Magistrate Etah is actually specific, because I was never advised by my District Court counsel to challenge the proceedings before this Hon'ble Court, so in these circumstances the delay may be condone if any in filing the present writ petition."
4. Learned Standing Counsel submits that pursuant to the show cause notice, further proceedings must have been held and a highly belated cause is being sought to be pressed by means of present writ petition which cannot be permitted to be raised now.
5. This Court is satisfied that, on the one hand, latches have not been explained properly, on the other hand, the nature of show cause notice impugned in the writ petition itself reflects that further proceedings must have been held during the course of time which have not been brought on record.
6. For the said reasons, this Court is not inclined to entertain the present writ petition.
7. The writ petition is, accordingly, dismissed. Order Date :- 21.7.2025 Mohit
