Heard Shri Ashish Kumar Srivastava, learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. The present petition has been filed by the petitioner seeking a direction to the revenue authorities i.e. respondent no.4 to incorporate his name in the revenue records pursuant to order of the Prescribed Authority (Ceiling), dated 15.01.2024. 2. In pursuance of the order of this Court dated 11.08.2025, learned Standing Counsel has obtained instructions, according to which, for incorporating the name of petitioner pursuant to order of the Prescribed Authority (Ceiling) dated 15.01.2024, the co-tenure holders are required to be heard, as such, sometime is required to carry out necessary incorporation in the revenue records. 3. Counsel for the petitioner contends that original notice under the U.P. Imposition of Ceiling on Land Holdings Act, 1960 was issued to the petitioner when certain land was declared surplus. The choice given by the petitioner under Section 12A of the aforesaid Act was initially rejected by the Prescribed Authority vide order dated 18.04.1984, against which, an appeal was filed by the petitioner in which the matter was remanded to the Prescribed Authority. Thereafter, the Prescribed Authority vide its order dated 15.01.2024 has accepted the choice of the petitioner and necessary incorporation was made in the register Malikan of village Belhari. However, the said incorporation was not carried out in Versus Counsel for Petitioner(s) : Ashish Kumar Srivastava, Shreya Srivastava Counsel for Respondent(s) : C.S.C. In view of the instructions received by learned Standing Counsel, the Prescribed Authority (Ceiling)/Chief Revenue Officer, Ghazipur is seized of the matter. 5. In the facts and circumstances of the case, the present petition is disposed of with a direction to the respondent no.3 to carry out necessary incorporation in the relevant revenue records, pursuant to order of the Prescribed Authority (Ceiling) dated 15.01.2024, preferably, within a period of three months from the date of presentation of certified copy of this order, if there is no other legal impediment.
