ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER Heard Smt.Kavyashree G. S., learned counsel for the petitioner.
2. Petition is filed under Section 24 of CPC with the following prayer:
“Wherefore, the petitioner respectfully pray that this Hon’ble High Court be pleased:
1. To pass an order transferring the matrimonial case filed by the respondent herein in MC No.66/2025 pending on the file of Principal Judge, Family Court, Chikkamagaluru produced as Annexure A to the Additional Civil Judge and JMFC Tarikere where the Cri. Mis. 92/2025 is pending same is produced as Annexure-C.

2. Grant such other relief as this Hon’ble Court deems fit under the facts and circumstance of the case including the order of cost in the interest of justice and equity.”

Facts in the nutshell which are utmost necessary for disposal of the petition are as under:
3.1. Respondent filed a matrimonial case in MC No.66/2025 under Section 13(1)(a) and Section 3 of the Hindu Marriage Act with a prayer for dissolution of the marriage between the parties.
3.2. The said case is pending on the file of Principal Judge, Family Court, Chikkamagalur.
3.3. Respondent being the resident of Ragi Basavanahalli village, Tarikere Taluk seeks transfer of the said case from Family Court, Chikkamagalur to Court at Tarikere.
4. The reason assigned is that the petitioner has to travel long distance from Tarikere to Chikkamagalur and she is unable to travel all alone.
5. Such a reason is not a good ground for grant of petition prayer having regard to the fact that geographical

HC-KAR NC: 2025:KHC:41902 CP No. 311 of 2025 distance is not one of the criteria for transfer, in view of the video conferencing facility being made available in the Courts at Chikkamagaluru as well as Tarikere.
6. Taking note of the fact that the petitioner can appear through video conference effectively and successfully participate in the pending matrimonial case, the petition prayer cannot be granted.
7. Accordingly, following:
ORDER i. Petition is dismissed. ii. However, if the petitioner makes an application availing the video conferencing facility, the Family Court at Chikkamagalur shall consider the same and permit the petitioner to participate in the proceedings through video conferencing facility.
