Learned counsel Smt. Supriya S.K. has filed vakalath for respondent No.2. The same is taken on record. 2. Petitioners are seeking to quash the proceedings initiated by respondent No.2 in PCR No.8667/2024, pending on the file of XXXIX Additional Chief Metropolitan Magistrate, Bengaluru. 3. Complaint was filed by respondent No.2, which was referred to police for investigation, consequent to which, a case in Crime No.297/2024 was registered at HSR Layout Police Station, Bangalore City for the offence

punishable under Section 503, 504, 339, 383, 182 and 211 of IPC. 4. Petitioners and respondent No.2 are present before the Court. A Compromise petition is filed signed by the parties, reporting settlement. It is stated that the disputes between the first petitioner and the second respondent has ended up in a decree of divorce by mutual consent and in view of the settlement, the second respondent is withdrawing all his allegations made in the current proceedings, arising out of PCR No.8667/2024. 5. The parties present before the Court have acknowledged the settlement between them. Respondent No.2 submits that in view of the settlement, he is not interested in continuing the proceedings initiated against the petitioners and he has no objection to quash the proceedings. 6. The matter arises out of a matrimonial dispute. From the compromise petition, it is seen that the Family

Court in MC No.2084/2024 referred the matter to Mediation Center, Bangalore, to explore the possibility of settlement wherein, petitioner No.1 and respondent No.2 agreed for divorce by mutual consent and Respondent no. 2 agreed to withdraw all allegations made and cases filed against each other. 7. In Jitendra Raghuvanshi and others v. Babita Raghuvanshi and another reported in 2013(2) Crimes 90(SC), it is held by the Apex Court that ‘the inherent powers of the High Court under Section 482 of Cr.P.C., are wide and unfettered. It is the duty of the Courts to encourage genuine settlements, even if the offences are non-compoundable and if it is satisfied that the parties have settled the same amicably without any pressure.’

In view of the settlement between the parties, no useful purpose will be served in continuing the proceedings pending against the petitioners. Hence, in the interest of justice, it is expedient to quash the proceedings. According to the following:-
ORDER
i) Petition is allowed. ii) The entire proceedings arising out of PCR No. 8667/2024, on the file of XXXIX Additional CJM, Bangalor, and the FIR in Crime No.297/2024 registered at HSR Layout Police Station are quashed.
